What Is The National Vaccine Injury Compensation Program?
The Vaccine Injury Compensation Program (VICP) provides an alternative to traditional litigation to resolve claims involving vaccine-related injuries. The VICP was created in 1986 to provide fair and efficient compensation to individuals who are affected by vaccines. It also limits liability for vaccine manufacturers and administrators to help ensure the necessary supply of vaccines.
The Vaccine Injury Compensation Trust Fund
The VICP is funded by the Vaccine Injury Compensation Trust Fund. Each time a CDC-recommended vaccine is administered to a child, the Department of the Treasury collects a $0.75 tax for each disease that is prevented. This tax goes into the vaccine injury fund, where it can be used to compensate victims of vaccine injuries and their families.
What Vaccines Are Covered?
The VICP applies to certain vaccines that have been shown to cause side effects and injuries:
- Diphtheria, tetanus and pertussis
- Haemophilus influenzae Type B
- Hepatitis A
- Hepatitis B
- Human papilloma virus (HPV)
- Seasonal influenza vaccines
- Measles, mumps and rubella
- Meningococcal
- Pneumococcal conjugate
- Polio
- Rotavirus
- Varicella
Most people receive these vaccines with no side effects, but others experience serious injuries. Learn more about symptoms associated with these vaccines.
Do I Have A Claim?
If you, your child or your legal guardian have received one of these vaccines and you believe it resulted in an injury, you may file a petition with the VICP. While it is not necessary to work with an attorney, many people choose to retain a lawyer for assistance with their petition. Attorney fees and costs are covered by the vaccine injury fund, not the client, so the risk to retaining a lawyer is low. If you work with an experienced attorney, like the ones at Giroux Pappas Trial Attorneys, P.C., you may be able to collect a much larger award.
